Terms of Service

1. Agreement to Terms

By accessing or using ComicGrades ("Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

ComicGrades is a comic book grading service that uses artificial intelligence to provide grade estimates and market pricing information. The Service is owned and operated by ComicGrades.

2. Account Terms

  • You must be 18 years or older to use this Service.
  • You must provide a valid email address to create an account.
  • You are responsible for maintaining the security of your account and password.
  • You are responsible for all activities that occur under your account.
  • You may not use the Service for any illegal or unauthorized purpose.
  • You must not violate any laws in your jurisdiction (including but not limited to copyright laws).

3. Subscription and Billing

3.1 Free Tier

  • New users receive 5 free comic gradings.
  • Free tier includes all grading features including AI analysis and eBay pricing.
  • No credit card required for free tier.

3.2 Pro Subscription

  • Pro subscription costs $8.99 per month.
  • Pro subscription provides unlimited comic gradings.
  • Billing occurs on a recurring monthly basis.
  • All charges are processed through Stripe, our third-party payment processor.

3.3 Cancellation and Refunds

  • You may cancel your subscription at any time through your account settings.
  • Upon cancellation, you will continue to have Pro access until the end of your current billing period.
  • No refunds or credits for partial months of service will be provided.
  • Refunds may be issued at our sole discretion in cases of service malfunction or billing errors.
  • If payment fails, your subscription will be downgraded to the free tier.

3.4 Price Changes

We reserve the right to change our subscription fees at any time. We will provide at least 30 days notice of any price changes via email. Continued use of the Service after a price change constitutes your acceptance of the new price.

4. Service Description and Limitations

4.1 AI-Generated Grades

IMPORTANT: ComicGrades uses artificial intelligence to analyze comic book images and provide grade estimates. These grades are ESTIMATES ONLY and should not be considered professional grading opinions or substitutes for professional grading services such as CGC, CBCS, or PGX.

  • AI grades are based on image analysis and may not detect all defects or conditions.
  • Grades are provided on a 0.5 to 10.0 scale similar to professional grading standards.
  • We do not guarantee accuracy of AI-generated grades.
  • You should not rely solely on our grades for purchasing, selling, or insurance purposes.

4.2 Pricing Information

Market pricing information is sourced from eBay's public API and represents recent completed sales. This information is provided for reference only and:

  • May not reflect current market conditions.
  • Does not constitute financial or investment advice.
  • Should not be the sole basis for buying or selling decisions.
  • May not be available for all comics.

4.3 Image Usage

  • You retain all rights to images you upload to the Service.
  • By uploading images, you grant us a license to process and analyze them for providing the Service.
  • Images are stored securely and used only for your grading history.
  • You must own or have permission to upload all images to the Service.

5. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • The accuracy, reliability, or completeness of AI-generated grades.
  • The accuracy of pricing information.
  • The availability or uninterrupted operation of the Service.
  • The suitability of the Service for any particular purpose.

WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, VIRUS-FREE, OR THAT DEFECTS WILL BE CORRECTED.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMICGRADES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Any loss of profits, revenue, data, or goodwill.
  • Any damages resulting from use or inability to use the Service.
  • Any damages resulting from reliance on AI-generated grades or pricing information.
  • Any damages resulting from buying or selling decisions based on Service information.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

7. Intellectual Property

The Service, including its software, algorithms, design, text, graphics, and other content (excluding user-uploaded images) is owned by ComicGrades and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of our Service without our express written permission.

8. Prohibited Uses

You agree not to use the Service to:

  • Upload images you do not own or have permission to use.
  • Attempt to reverse engineer or extract our AI models or algorithms.
  • Use automated systems or bots to access the Service.
  • Scrape or harvest data from the Service.
  • Interfere with or disrupt the Service or servers.
  • Impersonate any person or entity.
  • Violate any applicable laws or regulations.
  • Resell or redistribute access to the Service.

9. Account Termination

We reserve the right to suspend or terminate your account at any time for:

  • Violation of these Terms of Service.
  • Fraudulent activity or payment disputes.
  • Abuse of the Service or excessive usage that impacts other users.
  • Any reason at our sole discretion.

Upon termination, your right to use the Service will immediately cease. We may delete your account and data, though we may retain certain information as required by law.

10. Third-Party Services

Our Service integrates with third-party services:

  • Stripe: Payment processing. Subject to Stripe's Terms of Service.
  • OpenAI: AI analysis. Subject to OpenAI's Terms of Use.
  • eBay: Pricing data. Subject to eBay's Terms of Service.

We are not responsible for the availability, content, or practices of these third-party services.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

Any disputes arising from these Terms or use of the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for intellectual property disputes.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.

These Terms constitute the entire agreement between you and ComicGrades regarding the Service and supersede all prior agreements and understandings.
